DA Willis Appeals Being Ousted From Trump Election Case

Democrat Fulton County District Attorney Fani Willis asked the Georgia Supreme Court on Wednesday to reverse her disqualification in the election interference case against President-elect Trump, according to a court filing.

"No Georgia court has ever disqualified a district attorney for the mere appearance of impropriety without the existence of an actual conflict of interest," Willis’ appeal stated. "And no Georgia court has ever reversed a trial court’s order declining to disqualify a prosecutor based solely on an appearance of impropriety."

The filing argued the 2-1 ruling "overreached the Court of Appeals' authority," creating a new standard for disqualification of a prosecutor and disregarding decades of precedent.

Last month a Georgia appeals court ruled that the secret relationship between Willis and former special prosecutor Nathan Wade was sufficient enough grounds to conclude the trial court should have disqualified Willis and her office from prosecuting Trump. The romantic relationship between Willis and Wade gave the "appearance of impropriety" and thus the pair were unable to fairly prosecute the case.

In August 2023, Trump was indicted on racketeering, conspiracy and other charges by a grand jury in Fulton County over allegations of trying to subvert the state results of the 2020 election. Trump pled not guilty and has vehemently denied any wrongdoing.

It was one of four criminal cases brought against Trump in the run-up to the 2024 election. Special counsel Jack Smith dropped both of his two federal prosecutions when Trump won the election. Trump is scheduled to be sentenced Friday following his conviction in New York on falsifying business records, a decision Trump is appealing.

The president-elect has denied wrongdoing in all of the cases and said he is the victim of political prosecutions brought by the Biden administration and other Democrats who oppose him.
