The U.S. Court of International Trade last week ruled that President Donald Trump's sweeping tariffs on goods imported from almost every foreign nation were illegal.
The court determined that the International Emergency Economic Powers Act does not grant the president unbounded authority to impose tariffs.
Sen. Roger Marshall, R-Kan., told Newsmax Congressional Correspondent Kilmeny Duchardt on Tuesday that the courts should let Trump "do his job."
"The president is doing the will of the people," Marshall said on "Newsline." "I don't know that the system is broken. I don't know that we need to do anything else. I think that there are laws in place and there should be this constant balance of power, as the Founding Fathers meant there to be."
Marshall and fellow GOP Sen. Chuck Grasley of Iowa introduced legislation in April to stop abuses of federal injunctions against Trump. Marshall said he expects the Judicial Relief Clarification Act of 2025 to end up in the Supreme Court.
"When this gets to the Supreme Court, and that's who's ultimately going to decide this, it won't be a unanimous decision," Marshall said. "I bet it will be 6-3 or 5-4. I think the laws are on the books right now. And we should let the president do his job and give him some rope to bring these jobs back home to stop the flow of fentanyl."
