Judge Boasberg Memo Reveals Bias Against Trump Admin

Washington, D.C. District Court Judge James Boasberg expressed concern that the Trump administration would not obey federal court rulings, revealing a predetermined judicial bias against the White House, the Federalist reported Wednesday.

In an exclusive memo obtained by the outlet, during a Judicial Conference in March, Boasberg told Chief Justice of the Supreme Court John Roberts that he and some of his fellow judges felt "the Administration would disregard rulings of federal courts leading to a constitutional crisis." The presumption by Boasberg disregards the presumption of "regularity," the outlet noted, a presumption that "requires a court to presume public officials properly discharged their official duties."

"Chief Justice Roberts expressed hope that would not happen and in turn no constitutional crisis would materialize," the memo continued adding that Justice Roberts noted "his interactions with the President have been civil and respectful, such as the President thanking him at the state of the union address for administering the oath."

Only days after the conference took place, Boasberg blocked the Trump administration's use of the Alien Enemies Act, which the president invoked as justification for the rapid deportation of members of the Venezuelan Tren de Aragua gang. Boasberg called the actions of the Trump White House "incredibly troubling and problematic," adding the administration engaged in "an unprecedented and expanded use of an act that has been used ... in the War of 1812, World War I and World War II, when there was no question there was a declaration of war and who the enemy was."

The Supreme Court would eventually overturn the lower court's ruling in a 5-4 decision, but the comments revealed by the Federalist show Boasberg and some of his fellow district judges maintained a bias against Trump and the administration, despite having complied with every court order handed to them.
