Harvard law professor emeritus Alan Dershowitz told Newsmax on Monday that he talks frequently with Israel Prime Minister Benjamin Netanyahu and said there is cautious optimism about a deal to return some of the hostages taken during Iranian-backed Hamas' terrorist attack on Oct. 7, 2023.

"But they all have to be returned," Dershowitz told "The Record With Greta Van Susteren" and guest host Bianca de la Garza. "Many of them probably are no longer alive because we know that Hamas killed so many of them."

Dershowitz said he met with President-elect Donald Trump last week, and they talked about the hostage situation in Gaza. Among the 96 hostages still being held in Gaza who were kidnapped Oct. 7, The Times of Israel reported Monday that 34 were confirmed to be dead by Israel Defense Forces. Three Americans are still believed to be alive in Gaza, and the bodies of four others are still being held there, according to The Washington Post.

"I met with President Trump last week and we talked about this, and he said he was convinced that many of the hostages were killed by the brutality of Hamas, who murdered them while in captivity," said Dershowitz, whose latest book "The Ten Big Anti-Israel Lies: And How to Refute Them with Truth" was released last month. "But the remaining ones must be returned and must be returned quickly.

"I know that President Trump will keep his promise when he said, if they're not returned by Jan. 20, there will be hell to pay, and there must be hell to pay, because innocent people ranging from babies to septuagenarians, have to be freed and allowed to come home."
