Senators Ask Durham Why FBI Officials Didn't Talk

Two lawmakers are asking special counsel John Durham to explain why top FBI officials refused to comply with his probe.

In a Tuesday letter, Republican Sens. Ron Johnson of Wisconsin and Chuck Grassley of Iowa singled out former FBI Director James Comey and Deputy Director Andrew McCabe as key witnesses who declined to be interviewed.

"As we continue to review the report, we noticed that several high-level former government officials directly involved in Crossfire Hurricane either declined or partially declined to cooperate with your investigation," the pair wrote.

"It seems odd that individuals would be allowed to avoid fully cooperating with your office, particularly given your authority to compel testimony and records," they added.

Comey and McCabe, as well as former FBI agent Peter Strzok, former counterintelligence assistant director Bill Priestap, and convicted former FBI lawyer Kevin Clinesmith were not interviewed by Durham. Glenn Simpson of Fusion GPS was also not interviewed.

The pair asked for information on whether Durham issued subpoenas to those specific individuals and whether the Justice Department acted as a roadblock to any of his investigative work.

In a statement to the Daily Mail, the FBI said corrective actions are now in place to prevent similar circumstances to 2016, when the Foreign Intelligence Surveillance Act was used to spy on former President Donald Trump's campaign.

"The conduct in 2016 and 2017 that special counsel Durham examined was the reason that current FBI leadership already implemented dozens of corrective actions, which have now been in place for some time," the agency said.

"Had those reforms been in place in 2016, the missteps identified in the report could have been prevented," it continued. "This report reinforces the importance of ensuring the FBI continues to do its work with the rigor, objectivity, and professionalism the American people deserve and rightly expect."
