Manhattan District Attorney Alvin Bragg's office Tuesday said it will not oppose a request from President Donald Trump to file a motion that argues his felony conviction should be tossed in the wake of the Supreme Court's ruling on presidential immunity.
That will almost certainly delay Judge Juan Merchan's sentencing date currently set for July 11.
The letter, signed by five assistant district attorneys, and obtained by Newsmax, noted that it received the letter from Trump's team, dated Monday, seeking leave to file a motion to set aside the verdict that was reached in the 34-count case, and the request for a deadline of July 10, just one day before the original sentencing date.
"Although we believe defendant's motion is without merit, we do not oppose his request for leave to file and his putative request to adjourn sentencing pending determination of his motion," the DA's office said. "We respectfully request a deadline of July 24, 2024 — two weeks after defendant's requested deadline — to file and serve a response."
Trump's attorneys sent a letter to Merchan on Monday, citing the Supreme Court's ruling and asking him to delay the former president's sentencing date until he considers how the decision could affect the conviction.
