Harvard law professor emeritus Alan Dershowitz told Newsmax on Thursday the indictment of former President Donald Trump by a Manhattan grand jury is constitutionally "very, very questionable."
"It's not about politics," Dershowitz, a self-proclaimed liberal Democrat who maintains he wants his right to vote against Trump a third time, told "The Record With Greta Van Susteren." "I love the legal system. I've been doing this for 60 years. I've never quite seen a case like this.
"And for it to be the first prosecution of former president and the first prosecution of a man who's running for president against an incumbent Democrat, being indicted by a Democrat –a popular-elected Democrat – on a case of thin as this: I'll tell you, it's Banana Republic time."
The case just is too weak to bring against the opposition leader in an honest democracy, Dershowitz told host Greta Van Susteren.
"When you're going after the man who is running for president of the United States against the incumbent president, you better have a strong case, and this is about the weakest case I've seen in 60 years of law practice," he said.
Dershowitz is "shocked" about the bold attack on the political opposition, but not surprised people like New York Attorney General Letitia James and Manhattan District Attorney Alvin Bragg are carrying through on political campaign promises to "get Trump."
"This is the worst case of prosecutorial discretion abuse I've seen, but how can anybody be surprised when the attorney general of New York and the district attorney both run on the promise to get Trump," Dershowitz continued. "They have to keep their political promise.
"They get elected and then they rummage through all the statue books to try to find to pin on him and they can't find anything.
Dershowitz, author of "Get Trump: The Threat to Civil Liberties, Due Process, and Our Constitutional Rule of Law," said Bragg went to lengths he has not seen before to stretch legal statutes in order to find a way to charge Trump.
"One plus one equals 11," Dershowitz lamented on the lack of legal logic. "But it's zero plus zero equals zero."
