Former New Jersey Superior Court Judge Andrew Napolitano told Newsmax on Monday that he was "furious" to hear the president of the United States "thumbing his nose at the Supreme Court."
Napolitano was reacting to a statement President Joe Biden made Sunday in Henderson, Nevada, about his student loan forgiveness plan, most of which the Supreme Court shot down last July by a 6-3 margin.
"The Supreme Court blocked me, but they didn't stop me. I found another way," Biden said in his speech.
"The statement is outrageous and undermines democracy," Napolitano said on "Carl Higbie FRONTLINE."
Napolitano laid out what Biden did vs. what the SCOTUS ruling disallowed him from doing.
"The Supreme Court did not rule that he couldn't cancel all student debt. The Supreme Court ruled that he only couldn't cancel debt that resulted in the government paying money that had not been authorized by Congress," Judge Napolitano said. "There are 15 or 16 different programs under which this student debt exists. Most of them, if the debt is canceled, Congress has to pay it. The money came from the banks, the government guaranteed the money to the banks. If the banks don't get paid, the government has to pay the banks.
"There are one or two where there is no such guarantee. So the banks would be left holding the bag rather than the government," Napolitano told Higbie. "Those he can cancel, and then the banks would have to sue the government. And by the time that lawsuit is heard, even if, God forbid, it doesn't happen, he is reelected in November, this wouldn't come to pass until after he's out of office. It's a very complicated issue.
"But I am furious to hear the chief executive officer of the United States of America thumbing his nose at the Supreme Court. The Democrats love to do this. They're trying to do it with guns, now they're trying to do it with debt," the judge said.
