Indiana AG to Newsmax: County Sheriff Not 'Above the Law'

Indiana Attorney General Todd Rokita told Newsmax on Tuesday that St. Joseph County Sheriff William Redman is not "above the law" and is required to follow state immigration regulations.

Rokita filed a lawsuit Friday against Redman and the county's police, accusing the department of consistently failing to notify Immigration and Customs Enforcement (ICE) of the release of illegal immigrants and for its refusal to honor ICE detainment requests.

Amid a nationwide deportation of criminal illegal aliens by the federal government, Rokita trumpeted the efforts of President Donald Trump and border czar Tom Homan.

"We've been communicating since October about him [Sheriff Redman] becoming compliant with Indiana law, which states you cannot have an environment that is a sanctuary city environment. And that's what he's doing here," Rokita said on "Wake Up America." "He only lets ICE know that he's released an illegal alien instead of notifying ICE when that illegal alien is still in custody."

Rokita, a former Republican congressman, noted that Redman and his department have been acting in "a pattern" of illegal conduct.

"It doesn't do ICE any good to be notified after the release has occurred — and when you do that over a period of time and have a pattern like for six months that we've counted at least nine times the sheriff didn't notify ICE that about someone they had in custody that was under an ICE detainer," Rokita said. "There's a pattern of acting like a sanctuary county. So we're suing him because he's violating Indiana law, and no one is above the law."
