A judge has denied Cher's bid to serve as her 47-year-old son Elijah Blue Allman's temporary conservator.
Judge Jessica A. Uzcategui of the Los Angeles Superior Court ruled that the "Believe" singer did not provide Allman and his legal team with sufficient time to review essential documents ahead of a Friday hearing, according to court documents obtained by Entertainment Tonight.
The required documents were to be sent at least five days before the hearing.
Cher recently submitted documents hoping to immediately establish a conservatorship due to concerns over Allman's severe mental health and substance abuse problems, fearing his inability to manage his financial assets. Allman receives income from a trust established by his late father, musician Gregg Allman.
In her court filing, Cher stressed the urgency of setting up a temporary conservator due to an impending trust payment, calling it a "life-and-death proposition." However, the judge said she was "not persuaded," Entertainment Tonight reported.
When approached on Thursday to comment on her decision, Uzcategui cited the singer's reluctance to share materials with Allman's attorneys, according to the outlet, which cited Cher as stating that the documents held sensitive information and that she would prefer providing them only to Allman's court-appointed lawyer.
Allman meanwhile, has argued in court documents that his mother is "unfit to serve" as his conservator and that a conservatorship is not necessary. He admitted to previous struggles with addiction, but has been receiving treatment and is three months sober.
In court documents, Allman noted that if a conservatorship becomes necessary, he would appoint his wife, Marie Angela King, as the conservator. This decision comes after he recently withdrew his divorce filing and said they are no longer estranged.
"Given that I no longer have an active dissolution case, I believe that my wife would have priority to be appointed conservator, if necessary, but I do not need that either," Allman said in court documents, according to USA Today. "Under no circumstances am I comfortable having my mom as my conservator even if that was necessary."
