Telecom Company Urges FCC to Reverse Biden-era Fine

Some businesses are sounding the alarm that Biden-era policies are still negatively impacting them, with the previous Democrat agenda still clinging to some government agencies.

"[Former President Joe] Biden-era bureaucrats are still in play," said David Casem, the CEO of telecommunications service provider Telnyx to Newsmax. "They're still preventing businesses from succeeding in this country."

Casem said the Federal Communications Commission, which has faced criticism from conservatives for its regulation-by-enforcement over the last four years, is one of the agencies still bogged down by Biden's policies.

President Donald Trump made reversing this a top priority, signing two executive orders in his first weeks in office to stop the punishment of American companies for the actions of bad actors.

One of Trump's orders calls for transparency and the elimination of surprise in federal enforcement actions. Another calls for the elimination of unconstitutional regulations.

"We are grateful that President Trump was elected," Casem said. "That he is dismantling the bureaucracy across Washington, and that he's stopping regulation-by-enforcement.

"Think of all the companies that weren't created in the last four years because of the previous administration's policies."

Telnyx is one of the American companies still being punished, according to the company. Currently, it is facing a $4.5 million fine from the previous administration's FCC.

The FCC's complaint against Telnyx stems from a robocall scam the company said was by bad actors that targeted officials at the FCC and their family members.

On Feb. 6, 2024, the FCC said more than a dozen of its staff received a robocall on their personal and work numbers. At least one of them was apparently asked to send $1,000 in Google gift cards to avoid jail time.

According to a press release by Telnyx, 1,000 completed calls by a sophisticated bad actor relied on an apparent FCC security breach to intentionally target FCC employees.

Telnyx said they shut down the bad actor in 17 hours, and said the FCC weaponized a "know your customer" regulation.

Casem said he is confident the new FCC will find that Telnyx followed all laws and worked tirelessly to ensure the safety and security of their customers.

"Chairman [Brendan] Carr has a fantastic record on this," said Casem. "He has made it clear that in his FCC, there will not be regulation-by-enforcement. We look forward to this making it to the chairman's desk."

Telnyx said it hopes its story will shed light on the issue and encourage American tech companies to "throw their hat in the ring" of American business again.

Newsmax reached out to the FCC chair and current commissioners, but did not immediately receive a reply.

However, a former commissioner adviser told Newsmax that this new FCC "could turn the tide if they utilize more political appointees who are on board with the President's policy goals in having agencies treat small businesses more fairly.

"This is most likely to be accomplished through the White House via a new executive order reining in independent agencies to align with the President's priorities, putting more pressure on agency leaders to exercise their power cohesively."
